Families File Suit in Celina ISD Locker Room Recording Case

Under new law, public schools accountable for sexual misconduct

Dallas (October 22, 2025)—Herz Law and Bruce Kaye have filed suit in Collin County District Court on behalf of families whose sons attend Moore Middle School in Celina, based on information from police that assistant football coach, William Caleb Elliot, allegedly, secretly captured images of 14- and 15-year-old boys naked in the boys’ locker room.

On October 3, 2025, a student allegedly told the school that Mr. Elliott had been taking pictures of them, leading to the Celina Police Department seizing Mr. Elliott’s phone and arresting him on suspicion of invasive visual recording and, later, on suspicion of possession of child pornography.

If Mr. Elliott filmed children naked in a locker room, it is a crime, and the State will enforce its criminal laws. Only a civil suit, however, can make these families and these children whole. We have sued Mr. Elliott for invasion of privacy and intentional infliction of emotional distress. We have also sued Celina ISD under a new law, Texas House Bill 4623, that the Legislature passed in June of this year and went into effect September 1. Before this law, we had seen many cases against institutions like private schools and churches for sexual misconduct, but public schools were largely immune. With H.B. 4623, a public school can be held accountable when those employees commit certain forms of sexual misconduct, including invasive visual recording.

We commend the Legislature for standing up for families and victims of abuse in public schools. Because this is a new law, however, it now falls to us to test this law in the courts through this case of first impression. We owe our clients and every family that will come after them to not only obtain a recovery in this suit, but to be defenders of the law.
