Herz Law’s Celina ISD Suit Leads to Third Arrest of William Caleb Elliott

Minor’s allegation generates arrest warrant on suspicion of inducing sexual performance by a child

Dallas (November 7, 2025)—Herz Law and Bruce Kaye are aware of an additional arrest warrant, believed to be the third, issued against William Caleb Elliott on suspicion of inducing a sexual performance by a child, a second-degree felony. See Tex. Penal Code § 43.25(b). This arrest is a direct product of Plaintiffs’ lawsuit and the allegations therein and would not have occurred without the courage of the young victim involved.

Elliott is the former assistant football coach at Moore Middle School in Celina, Texas, and was arrested on suspicion of invasive visual recording of nude and bathing children in the locker room. He was subsequently arrested on suspicion of possession of child pornography after review of the contents of Elliott’s seized cell phone.

Herz Law, on behalf of the parents of three affected families, filed a lawsuit in October alleging that this recording by cell phone, and voyeurism by the naked eye, invaded the privacy of these minor victims. Plaintiffs are suing under a new law that allows independent school districts to also be held accountable for the sexual misconduct of their employees. See Tex. Civ. Prac. & Rem. Code ch. 118 (H.B. 4623). Since then, Plaintiffs amended their lawsuit to include a total of twelve affected families. Other victims have initiated separate suits in Collin County.

Many of the allegations in the original lawsuit were known to law enforcement at the time they were filed—namely, the recording and voyeurism. However, the description of Elliott making a young boy do jumping jacks naked was new information. Plaintiffs directly cited to the criminal law against “sexual performance by a child” because it is one of the forms of “sexual misconduct” in the new law that waives governmental immunity and allows victims to sue a school district. See Tex. Civ. Prac. & Rem. Code §§ 118.001(4) (“sexual misconduct” defined based on criminal laws), 118.002(a) (liability of public school), 118.006 (immunity waived). Celina PD’s investigation and arrest under the same criminal law for the same conduct followed.

While the story shocks the conscience, it is just another example of how the minors in this case are all “untouched victims” of sexual abuse. Plaintiffs, through their counsel, intend to continue cooperating with Celina PD, the Office of the Attorney General, the Department of Family and Protective Services, and any other investigative and legislative bodies. We are grateful for their public service and continued attention to abuse in schools.
